(1) Die Leistungen des Anbieters für den Online-Shop unter www.reuter-verlag.com
erfolgen ausschließlich auf der Grundlage der nachfolgenden Allgemeinen
Geschäftsbedingungen in der zum Zeitpunkt der Bestellung gültigen Fassung.

(2) Unsere Allgemeinen Geschäftsbedingungen gelten ausschließlich. Von unseren
Allgemeinen Geschäftsbedingungen abweichende AGB des Bestellers haben keine
Gültigkeit, es sei denn wir stimmen diesen ausdrücklich zu.

§ 2 Vertragsschluss

(1) Unsere Angebote im Internet stellen eine unverbindliche Aufforderung an den
Kunden dar, Waren zu bestellen. Durch das Absenden der Bestellung auf unserer
Website gibt der Kunde ein verbindliches Angebot auf Vertragsschluss ab.

(2) Die Bestätigung des Eingangs der Bestellung folgt unmittelbar nach dem

hat der Besteller die Möglichkeit nachzuweisen, dass der geltend gemachte
Verzugsschaden überhaupt nicht oder in zumindest wesentlich niedrigerer Höhe
angefallen ist.

§ 4 Eigentumsvorbehalt

Wir behalten uns das Eigentum an der gelieferten Sache bis zur vollständigen
Zahlung des Kaufpreises vor.

§ 5 Lieferung

(1) Die Lieferung erfolgt innerhalb von 3-5 Tagen bei einer Standardlieferung
innerhalb Deutschlands. Informationen zur Lieferzeit bei Expressversand, zur
Lieferung in andere Länder und zur Berechnung der Lieferfrist finden Sie hier (LINK

Auf eventuell abweichende Lieferzeiten weisen wir auf der jeweiligen Produktseite
hin. Der Beginn der von uns angegebenen Lieferzeit setzt die rechtzeitige und
ordnungsgemäße Erfüllung der Verpflichtungen des Kunden voraus, insbesondere
die korrekte Angabe der Lieferadresse im Rahmen der Bestellung.

Die Zugangsdaten für digitale Inhalte werden Ihnen nach Vertragsschluss direkt per
E-Mail übermittelt.

(2) Falls der Anbieter ohne eigenes Verschulden zur Lieferung der bestellten Ware
nicht in der Lage ist, weil der Lieferant des Anbieters seine vertraglichen
Verpflichtungen nicht erfüllt, wird der Kunde unverzüglich darüber informiert, dass die
bestellte Ware nicht zur Verfügung steht. Bereits erbrachte Gegenleistungen des
Vertragspartners werden unverzüglich erstattet. Die gesetzlichen Ansprüche des
Kunden bleiben unberührt.

(3) Gegenüber Unternehmern geht die Gefahr der Verschlechterung oder des
Untergangs der Ware mit der Übergabe des Liefergegenstandes an das
Transportunternehmen auf den Besteller über. Verzögert sich die Übergabe oder
Versendung aus vom Besteller zu vertretenden Gründen, so geht die Gefahr am
Tage der Mitteilung der Versandbereitschaft des Liefergegenstandes auf den
Besteller über.

§ 6 Annahmeverzug

(1) Kommt der Kunde in Annahmeverzug oder verletzt er schuldhaft sonstige
Mitwirkungspflichten, so sind wir berechtigt, den uns hierdurch entstehenden
Schaden einschließlich etwaiger Mehraufwendungen ersetzt zu verlangen.
Weitergehende Ansprüche bleiben vorbehalten.

(2) Der Kaufpreis ist während des Verzugs zu verzinsen. Der Verzugszinssatz
beträgt per anno fünf Prozentpunkte über dem Basiszinssatz. Bei Rechtsgeschäften
zwischen Unternehmern beträgt der Zinssatz acht Prozentpunkte über dem
Basiszinssatz.

(3) Dem Kunden bleibt seinerseits vorbehalten nachzuweisen, dass ein Schaden in
der verlangten Höhe nicht oder zumindest wesentlich niedriger entstanden ist. Die
Gefahr eines zufälligen Untergangs oder einer zufälligen Verschlechterung der
Kaufsache geht in dem Zeitpunkt auf den Besteller über, in dem dieser in Annahme-
oder Schuldnerverzug gerät.

§ 7 Gewährleistung

(1) Im Falle eines Mangels hat der Kunde die Wahl, ob die Nacherfüllung durch
Nachbesserung oder Ersatzlieferung erfolgen soll. Wir sind jedoch berechtigt, die
vom Besteller gewählte Art der Nacherfüllung zu verweigern, wenn sie nur mit
unverhältnismäßigen Kosten möglich ist und die andere Art der Nacherfüllung ohne
erhebliche Nachteile für den Kunden bleibt.

(2) Ist die Nacherfüllung fehlgeschlagen oder haben wir die Nacherfüllung insgesamt
verweigert, kann der Kunde nach seiner Wahl Herabsetzung des Kaufpreises
(Minderung) verlangen oder den Rücktritt vom Vertrag erklären. Eventuelle
Schadensersatzansprüche des Kunden bleiben hiervon unberührt.

(3) Ist der Kunde Unternehmer im Sinne des § 14 BGB gilt für die
Gewährleistungsansprüche des Kunden Folgendes als vereinbart: Offensichtliche
Mängel müssen gegenüber dem Anbieter unverzüglich, spätestens innerhalb von 14
Kalendertagen nach Lieferung der Ware schriftlich angezeigt werden, verdeckte
Mängel sind ebenfalls unverzüglich, spätestens innerhalb von 14 Kalendertagen
nach deren Bekannt werden schriftlich anzuzeigen. Erfolgt die Mängelanzeige nicht
fristgerecht, sind die Gewährleistungsrechte des Kunden bezogen auf den nicht
rechtzeitig angezeigten Mangel ausgeschlossen. Das gilt jedoch nicht, soweit der
Anbieter den Mangel arglistig verschwiegen und/oder eine entsprechende Garantie
übernommen hat. Gewährleistungsansprüche verjähren – außer im Fall von
Schadensersatzansprüchen – innerhalb eines Jahres nach Ablieferung der
Kaufsache an den Unternehmer.

§ 8 Haftungsbegrenzung

(1) Bei leicht fahrlässiger Pflichtverletzung beschränkt sich die Haftung des Anbieters
sowie der Erfüllungsgehilfen des Anbieters auf den nach der Art Ware
vorhersehbaren, vertragstypischen, unmittelbaren Durchschnittsschaden. Bei leicht
fahrlässigen Pflichtverletzungen von nicht vertragswesentlichen Pflichten, durch
deren Verletzung die Durchführung des Vertrages nicht gefährdet wird, haften wir
sowie unsere Erfüllungsgehilfen nicht.

(2) Die vorstehenden Haftungsbeschränkungen gelten nicht bei Ansprüchen aus
Produkthaftung oder aus Garantie sowie bei Ansprüchen aufgrund von Körper- und
Gesundheitsschäden sowie bei Verlust Ihres Lebens.

gesetzlichen Datenschutzvorschriften. Eine Weitergabe Ihrer Daten ohne Ihre

(2) Sind die Vertragsparteien Kaufleute, ist das Gericht an unserem Sitz in
Reutlingen zuständig, sofern nicht für die Streitigkeit ein ausschließlicher
Gerichtsstand begründet ist. Dies gilt auch, wenn der Kunde keinen Wohnsitz
innerhalb der Europäischen Union hat.

Soweit eine Bestimmung dieses Vertrages ungültig oder undurchsetzbar ist oder
wird, bleiben die übrigen Bestimmungen dieses Vertrages hiervon unberührt.
